    S/Court reserves judgement on withheld Osun LG funds by AGF

    The Supreme Court, on Tuesday, reserved judgement on the withheld Osun State Local Government funds by the Attorney General of the Federation (AGF).

    The Osun State Government was before the apex court seeking to stop the AGF from releasing the withheld LG’s funds to the disputed elected All Progressive Congress (APC) LG chairmen.

    The seven-man panel of the Apex court led by Justice Uwani Aba’aji reserved judgement to a date that will be communicated to the parties after Musbau Adetumbi (SAN) and Chief Akin Olujimi (SAN) canvassed their argument for and against the parties.

    Specifically, the Osun State Attorney General (AG) is praying the court to direct the AGF to immediately release the LG allocations to the chairmen and councilors validly elected for the 30 LGA’s of the state.

    The plaintiff is seeking the order of the court to stop the AGF from further withholding, suspending or seizing monthly allocations and revenues standing to the credit of the constituents’ local government having democratically elected chairmen in places.

    In his argument, the plaintiff submitted that the AGF was wrong in his letter recognising the APC LG chairmen when the matter was pending before court of records.

    Adetumbi also submitted that the election that brought in the APC officials as chairmen and councillors had been nullified by the federal high court and upheld by the Court of Appeal.

    Therefore, he prayed the court to upheld his arguments and grant all the reliefs.

    The respondent (AGF), in his argument raised a preliminary objection and urged the apex court to dismiss the case for lacking in merit.

    Olujimi posited that the plaintiff has no legal power to institute the matter at the supreme court to invoke the original jurisdiction because the matter is between two political parties.

    Moreover, the AGF maintained that the suit failed to disclose any cause of action.

    Olujimi also averred that the tenure of the disputed council chairmen is still running till October 22, adding that the proper thing was for the statutory allocation to be released to them to run the councils.

    Concluding, the AGF insisted that the plaintiff filed cases in about seven high courts on the same subject matter with the same parties.

    He asked the court to declare that the action is an abuse of court processes.

    Therefore, he urged the court to decline the reliefs and dismiss the suit.

    After listening to the arguments, the court reserved judgement at a later date.
