Rivers Court Suspends Fubara’s Impeachment Case Indefinitely

    Published on

A High Court sitting in Rivers State has adjourned, without a return date, the legal battle over the impeachment moves against Governor Siminalayi Fubara and his deputy, Professor Ngozi Nma-Odu.

The court, presided over by Justice Florence Fiberesima at the Oyigbo Division in Port Harcourt, ordered that the matter be put on hold indefinitely.

The judge made the decision after confirming that two separate appeals connected to the case have already been properly filed before the Court of Appeal.

Justice Fiberesima explained that the suspension would allow the appellate court to first determine the issues placed before it.

According to her, proceeding with the case at the High Court level could interfere with the appeals already entered.

The suit was filed by Governor Fubara and his deputy to challenge the impeachment steps initiated against them. The respondents in the case include the Speaker of the Rivers State House of Assembly, Martin Amaewhule, 26 lawmakers of the Assembly, and the Clerk of the House.

Before the latest ruling, the same court had issued an interim order aimed at halting the impeachment process. The order barred the Speaker, the lawmakers, and other named parties from forwarding articles of impeachment or related documents to the Chief Judge of Rivers State.

The court also restrained the Chief Judge, Justice Simeon Chibuzor Amadi, from receiving or acting on any impeachment-related communication.

This restriction covered any attempt to constitute a panel to investigate allegations of gross misconduct against the governor and his deputy within the period stated by the court.

The injunction was granted to maintain the status quo and prevent further action while the legal issues were being examined. It applied to several officials involved in the impeachment process, including the leadership of the House of Assembly.

With the case now adjourned sine die, all parties are expected to await the outcome of the appeals currently before the Court of Appeal.
