    DSS denies any involvement in arrest of Nnamdi Kanu in Kenya

    The Department of State Services (DSS) has denied any involvement in the controversial arrest of Indigenous People of Biafra (IPOB) leader, Nnamdi Kanu, in Kenya, maintaining that the agency only operates within Nigeria’s borders.

    According to reports, the clarification was made during the cross-examination of a DSS intelligence officer, identified as witness BBB, in court. When questioned about the agency’s capacity to carry out cross-border operations, BBB categorically stated that the DSS does not have the authority to make arrests outside Nigerian territory.

    “We do not have the powers to effect arrest beyond Nigeria’s borders,” he stated, dismissing claims that the DSS was responsible for Kanu’s alleged abduction from Kenya in 2021. Kanu has previously asserted he was “kidnapped” and forcibly returned to Nigeria.

    The witness also explained that the DSS functions under the supervision of the National Security Adviser (NSA) and operates independently of political interference. Responding to questions about political influence, BBB confirmed that ministers or the Attorney General do not direct DSS operations.

    Regarding intelligence gathering, BBB said the agency uses a variety of sources, including human intelligence, social media, and other channels, emphasizing that DSS operatives are well-trained in information collection.

    He further testified that Kanu’s Radio Biafra broadcasts incited violence, particularly during the 2020 EndSARS protests. BBB linked Kanu’s rhetoric to incidents such as the burning of a police station in Ebonyi State, the Lagos State High Court, and the cargo terminal at Murtala Mohammed Airport.

    At one point in the proceedings, defence lawyer Paul Erokoro sought an adjournment to submit a video clip as evidence. The court approved the request and admitted certified true copies of judgments from three human rights lawsuits Kanu had filed in courts in Abia, Umuahia, and Enugu.

    Earlier, proceedings opened with a warning from trial judge Justice James Omotosho against live-streaming the court session and improper use of social media. He specifically addressed Aloy Ejimakor, a defence team member, cautioning him over posts that could mislead the public.

    Lead counsel Kanu Agabi expressed concern about the unauthorised live-streaming of the trial, singling out Ejimakor’s actions and proposing a ban on mobile phones in the courtroom to prevent further breaches.

    Justice Omotosho stressed the need for professionalism, warning that further misconduct could result in sanctions, including possible disbarment. He also underscored the importance of a swift trial, given Kanu’s prolonged detention.

    The case was adjourned until Thursday, May 22, for the continuation of the cross-examination of the second prosecution witness.
